Legality
I recently received an email from a person that was simply looking out for people doing CASH GIFTING. The message said what you are doing is illegal so i started doing my homework. What I found was great. I was reassured again that it is 100% legal no mistakes. Churches, civic groups and people from around the world have participated in organized gifting for hundreds of years! Laws state that it is legal for individuals to exchange gifts. In the U.S. we have the Preamble, the Constitution and the Bill of Rights to protect a private citizen's right to earn, pay taxes and give away property and cash as long as it is done according to the laws and codes of this country.
You can give and receive up to $12,000 (effective Jan. 1, 2006) from any one person within a calendar year.
In the US, just look at the IRS Tax code Title 29 and Publication 950.
Legality
There has been a lot of discussion over the internet regarding the legality of cash gifting and there is no doubt, this debate will continue on for some time.
The short answer to the question "Is cash gifting legal?" is, it depends. Make no mistake, there has never been any question that the gifting of cash from one person to another is absolutely, without question, 100% legal. Nothing illegal about it. That's always been legal. The "legal cash gifting" question comes about when you examine the methods used to gift cash.
There are various cash gifting programs out there and they are NOT all alike. Some use similar methods and some don't. This is where the debate originates. For example, if a cash gifting program is structured in a pyramid fashion, whereas top level participants receive money from an expanding lower base, like those commonly found in multi-level marketing, then the legality of that program could be called into question. Multi-Level means more than one level, as in two or more participants away from the recipient.
There are other aspects that would render a cash gifting program illegal, such as a program that promotes itself as an INVESTMENT or a BUSINESS OPPORTUNITY. Investments fall under the Securities Act, which requires strict compliance to certain rules and guidelines. Gifting of money does not fall under this definition and cannot be legally termed as an investment. Also, under state laws, a business opportunity is a contractual obligation between a BUYER and SELLER. A two-way exchange of goods and/or services. Cash gifting is "not" a two-way deal!
Cash gifting only flows in one direction, from a GIVER to a RECEIVER. The person that gives a cash gift will receive absolutely nothing from the person receiving the gift. There is no exchange. Nothing from the RECEIVING end flows back to the GIVING end. Therefore, cash gifting cannot legally be called an INVESTMENT of a BUSINESS OPPORTUNITY. Most cash gifting programs adhere to strict guideline concerning the language involved with this activity. A gifter should avoid the use of terms like "EARN" or "MAKE" when referring to RECEIVING money. A participant in a cash gifting program does not make or earn money. They receive a gift with no strings attached. That gift is usually in the form of $100 dollar bills.
It is not illegal to receive a cash gift, nor is it illegal to give a cash gift. in fact, if you go to the IRS website and search publication 950, you will find that the Government clearly allows cash gifting and even states that you can gift cash to any number of individuals, up to $12,000 each, without having to declare or pay taxes on those gifts!
People give money to other people all of the time... on birthdays, graduation, handouts and charity. Nothing about the act of giving and receiving cash is illegal. However, the manner in which a cash gifting program is structured is at the heart of the issue. that is why you will find that many properly structured cash gifting programs employ a 1-up system for managing residuals.
The "1-up" is actually a variant of the Australian 2-up compensation plan used by some mlm companies. The difference is in the number of people that a member must pass up to their sponsor. The "2-up" requires that you pass up two people (mlm) vs the "1-up" (not mlm), where you only pass up 1 person. The 1-up system will be examined further during a later entry, but for now, just know that a cash gifting program that utilizes a 1-up system is most likely properly structured and legal.
Cash Gifting Is Illegal
What about all those website that say Cash Gifting is Legal?
This is an easy question. You'll need to pay close attention to those sites. Many sites actually PROMOTE cash gifting, but use the keyword phrases "scam" or "illegal" because they know you will click on their link. people would rather believe that cash gifting is illegal because it can generate so much money, so fast, that it just couldn't be legal. We have all been taught that if it sounds too good to be true, then it usually is... too good to be true. Well, you need to stop for a second and just consider that the possibility exists that this just might be true. There are other sites, that are competing for your money and still others that speak about that, which they do not know.
I know someone who has looked no further than a landing page and say that cash gifting is illegal and unethical. This same person lives with his mother and collects food stamps (not that there is anything wrong with that), but it clearly defines a skepticism out there that keeps people from ever achieving true wealth. You need to break out of that skeptical shell, do you own research (if you don't trust mine) and make a decision that can change your life.

You had commented on my lens Cash Gifting Defined and I wanted to let you know about a very low cost system that was sent to me...
